CyberPass" Contest

Terms and Conditions

Sony "CyberPass" Contest hereafter called “Contest” will be governed by the following Terms & Conditions:

1. Participation in the contest is voluntary.

2. Participants are advised to read the “Terms and Conditions”. Participation in the contest shall imply that the participant has duly read and agrees to adhere to and bound by the “Terms and Conditions” stated herein.

3. The contest shall commence from 12 noon May 14, 2013 and shall terminate on June 14, 2013 noon.

4. The contest is open to citizens of India, residents in India only. Employees of Sony India Pvt. Ltd. (“Sony India”), Sony Entertainment television (SET), Sony Pictures (SPE) and its affiliates, subsidiaries, representatives and immediate family members of such Sony group companies employees are not eligible to participate in the contest. Citizens of foreign countries residing in India/ or non-residents Indians are also not eligible to participate in the contest.

“How to Participate”, “Winners” & “ Prizes”

5.1 Contest will be hosted on a special microsite hosted at http://www.sony.co.in

5.2 . A participant has to be a Facebook user.

5.3 . Participants can login to the contest using their Facebook profiles (https:\\www.facebook.com, username and password). After login, participants will be directed to the main page where a video will be hosted explaining the working of contest.

6. On the contest dashboard, participants can upload pictures that they feel could have been shot better on the ‘upload’ section. One participant can upload one picture only. Participants are hereby advised, once their picture & related details have been uploaded the same cannot be changed.

7. All participants’ pictures will be visible at the “Gallery” section. Sony India will scrutinise all pictures for conditions mentioned under the ambit of “REJECTION/DISQUALIFICATION”. Any picture found flouting the “REJECTION/DISQUALIFICATION” terms will be deleted immediately without any prior notice to the participant. Sony India cannot be held liable for such action.

8. Any participants can vote just once for his or any other participants picture under any of the ambit as mentioned – “Nailed it/ Ok/ Dislike”. A vote casted once cannot be changed, also participants can vote one entry only once.

9. All submissions will be visible on “Gallery” section. Further these submissions can be sorted as – “Nailed it/ Ok/ Dislike”, where these profiles will be arranged as per the scores that they have gathered.

10. All pictures will be scored on the basis of following formula: [(Nailed it + Ok) – Dislike], where "Nailed it" vote adds 2 points, "Ok" vote adds 1 point and "Dislike" vote subtracts 1 point. Based on this formula, top profiles will be visible at the “Leaderboard” section. Sony India will consider the top 20 valid profiles from these participants to select three winners. A jury appointed by Sony India will check on the top 20 valid profiles to declare three winners.

“REJECTION/DISQUALIFICATION”

11. Sony India reserves the right to disqualify any entry if:

Participant’s picture is not a vacation or holiday image.
Participant’s picture is not a missed/ruined/spoilt shot where by a missed shot could be out of focus, hazy, blurry, without flash, unclear, coloured patches, event pictures etc.
Participant’s text does not talk about the details missed in the picture that don't make it perfect.

12. Any participant’s picture or text which is insulting, rude, appalling, insensitive, offensive in nature/ against moral sensibilities shall be not be considered for participation and duly rejected right away. We strongly discourage rude or insulting posts or entries, personal attacks or purposeless inflammatory posts, use of abusive language and profane words in your post or for any other participant/s. We will block all such Facebook profiles from the Contest right away.

13. Sony India reserves the right to disqualify any participant / even winner if it has reasonable reasons to believe that the participant/winner has breached any of the “Terms and Conditions” of the contest.

14. Any participant found to be copying other participants/non-participants picture/text or using any unauthorized or copyrighted picture/text shall be immediately banned from the Contest. Sony India shall not be liable for any copyright claims arising so forth.

15. Sony India shall not be responsible in any manner to anybody including any of the participants for the misuse of any picture/text submissions at this Contest.

16. Any Participant using manipulative means to garner more votes or jeopardise any other Participant’s entry by any means shall be banned from the Contest.

17. Sony India will do rigorous background check on the activities related to participation and voting in this contest to ensure that only genuine participants win the contest. Sony India will also send direct messages to any participant or voter for any participant to check upon the person’s participation at the Contest

18. Sony India reserves the right to decide the participant/winner should be selected in the event of disqualification/rejection of any of the participant.

“WINNERS”

19. Sony India and a jury appointed by Sony India reserves the sole rights to decide on three winners from the top 20 valid profiles appearing at the “Leaderboard” section only. Their decision on the winners is final and binding for all participants.

20. Sony India will do a rigorous check to verify the authenticity of winners/participants. This would include a check on the genuinity of the picture submitted by the winner and even other participants. All winners will be required to provide proof of the trip where the submitted pictures were clicked. Sony India can ask for any proof from the winner or any participant to validate that he has clicked the submitted picture, failing which the winner /participant may be cancelled/ removed from Contest right away. This is just to ensure that only genuine people participate and have a chance to win the Contest and spurious Facebook accounts are kept away from the contest.

“PRIZES”

21. FIRST WINNER – First winner gets a chance to go on a trip to the location where they had clicked the picture submitted in this Contest, provided the conditions mentioned in ambit of “REJECTION/ DISQUALIFICATION” are taken care of. Sony India will sponsor the travelling amenities for this trip. First winner will also be given a Cyber-shot WX300 camera to click pictures during his trip and will be required to share these pictures with Sony India.

22. Sony India may use the winner’s picture further in marketing communication purpose with due credit to the winner. This shall not be treated as Copyrights violation in any manner.

23. The trip expenses and camera cannot be encashed for money.

24. The winner shall be invariably required to produce valid identity proofs & proof to validate that he had clicked the submitted picture. The winner shall be required to provide self attested proof of identity, proof of residence, email copy and all other necessary documents for verification. In case of the validation failure the trip and prize will be cancelled.

25. Winner must claim the trip & prize and submit all documents for reviews in the manner communicated by Sony India. In case the winner fails to contact the specified person on or before the designated date i.e. July 1, 2013 the winner shall be deemed to have surrendered the prize.

26. All taxes and other levies applicable to the prize shall be borne by the winner.

27. Sony India may, without advance notice cancel, suspend or postpone the contest at any time.

28. The ‘Terms and Conditions’ contained herein and as amended/ modified from time to time as mentioned at the Sony India’s website http://www.sony.co.in shall apply to this Contest.

29. In case of change in date of event or cancellation thereof for any reason beyond control of Sony India, Sony India shall not be responsible in any manner whatsoever.

30. Disputes relating to this Contest shall be subject to the exclusive jurisdiction of courts in Delhi only.

31. Contest is not applicable in the State of Tamil Nadu.

32. Participants who have not attained the age of majority i.e. 18 shall be required to get a written consent from the parent/ guardian in order to claim prize.

CHANGES TO THE TERMS AND CONDITIONS

33. We may change these conditions from time to time without prior notice. It is the User’s responsibility to check regularly, in order to ascertain if any changes have been made to these Terms and Conditions.
