Terms and Conditions: Statement for VAIO Overseas Service


PLEASE READ THIS DOCUMENT CAREFULLY BECAUSE IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

This Contract contains the current terms and conditions that apply to your purchase from us on orders for VAIO Overseas Services. You acknowledge that you are fully aware of the contents of these terms and conditions and, on placing any purchase order for the Services (hereinafter defined), you agree to be bound by and accept these terms and conditions.

The above mentioned service (“Service”) provides repair service at no charge in the designated countries under the terms and conditions mentioned below. The Service can be purchased by customers (“Customers”) who purchased designated Sony’s laptop personal computer products “VAIO” (“Product”) through Sony or a Sony’s official distributor. If Customer does not agree to this Terms and Conditions, Customer may not use the Service and it will not be made available to Customers.

  1. Eligible customers and products

  2. The Service is available only for Customers. The Service can be purchased only within sixty (60) days after the date of purchase of the Product.
  3. Period during which the Service is covered

  4. The Service is valid for a period of twelve (12) months from the original date of purchase of the Product.
  5. Designated areas where the Service is provided

  6. Whether the Service is provided at no charge or for a fee, the Service is offered only in the countries stated below. Sony reserves the right to change the designated areas at its sole discretion.

    Asia Japan, Hong Kong, South Korea, Taiwan, Malaysia, Thailand, Singapore
    Oceania Australia, New Zealand
    Western Europe Andorra, Austria, Belgium, Cyprus, Denmark, Finland, France, Germany, Gibraltar, Greece, Ireland, Italy, Liechtenstein, Luxemburg, Monaco, the Netherlands, Norway, Portugal, San Marino, Spain, Sweden, Switzerland, United Kingdom
    Middle East United Arab Emirates, Saudi Arabia

  7. Acceptance

  8. Unless Customer notifies Sony to the contrary by telephone, facsimile transmission or telex within seven (7) days of delivery and such notification is confirmed in writing within seven (7) days of the notification, Service shall be deemed to have been accepted by Customer as being in good condition and in accordance with this terms and conditions.
  9. Free–of–Charge repair coverage

  10. Under this Terms and Conditions, repair (i.e., labor and parts replaced by new and /or reconditioned parts) at no charge applies only to the hardware unit of the Product. Software, cables, peripherals and printed materials (such as instruction manuals, labels, etc.) are not covered under the Service. All defective parts replaced under this Limited warranty will become the property of Sony.
  11. Method of repair request

  12. If repair is necessary under this Terms and Conditions, please request repair by calling the designated Sony number.
  13. Free–of–Charge repair conditions

  14. Under this Terms and Conditions, repair at no charge is provided for defects in materials or workmanship under standard usage (as stated in the instruction manual, labels, and other printed material included with the Product). Power and telecommunications standards for the model types designated for the Service are for use in purchased country. When using the Product in the designated countries, it is the Customer’s responsibility to ensure that the Product is used in compliance with these specifications. When the defect is caused by use in an environment that does not meet the specifications of the Product, you will be charged for the repair.
  15. Warning concerning damage to equipment other than the Product

  16. Power and telecommunications standards for the model types designated for the Service apply to use in purchased country. Sony will not compensate for damage caused to any material or persons other than the Product when the Product is used in an environment that does not meet the specifications of the Product.
  17. Warranty Disclaimer

  18. SONY SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY RELATED TO THE PRODUCT. SUCH DAMAGES INCLUDE BUT ARE NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, DOWN TIME AND PURCHASER?S TIME. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THE PRODUCT IS DISCLAIMED.
  19. For–fee repair conditions

  20. If a repair is requested under the conditions listed below, a fee will be charged:
    • Cosmetic damages
    • When the damage is due to accident, misuse, abuse, negligence, unauthorized commercial use or unauthorized modifications of the Product
    • When the damage is due to improper operation or maintenance of the Product
    • When the damage is due to connection to improper voltage supply
    • When the damage is caused by transporting the Product after purchase, or by dropping or hitting the Product
    • When the damage is due to acts of God; caused by fire, earthquakes, floods, lightening, pollution, power surges
    • When the damage is due to the attempted repair by any party other than a Sony authorized personal computer service facility
    • When malfunction results from the use of the Product in conjunction with accessories, products or ancillary or peripheral equipment or where it is determined by Sony that there is no fault with the Product itself
    • When there is a request to ship the Product outside of the designated countries in which the repair is requested
    • When the factory applied serial number has been altered or removed from the Product

    • Please be aware of the following in connection with repairs for which there is a charge:
    • For repairs charged, you must pay for parts, labor, and shipping charges.
    • Details of the fee will be explained in cases where you will be charged.
    • The fee may differ from the fee charged on an equivalent repair in purchased country due to currency fluctuations, differences in parts prices, etc.
    • If Sony has found the repair to be for-fee after receiving the Product, Sony will contact you before performing the repair. You will be informed of the charge and asked to confirm whether the repair should be performed. In such circumstances, the period during which the Product is away from you may be longer than when repairs are performed at no charge.
    • In certain countries, you may require a credit card to make payments for for–fee repair.
    • If Sony decides that you will be charged for the repair, but the Product is returned to you unrepaired because you do not wish to have the repair performed, the shipping cost will be charged to you.
  21. Important notice about repair procedures

    • The conditions for accepting a repair request are as follows:

    • You own either of the Products and have purchased the Service for the Product
      You are staying in the designated countries for sufficient period to repair the Product.
      The contents of your hard drive, including any data you have stored or software you have installed, are duly backed up by you before the Product is collected by the courier.
    • It is your responsibility to back up the contents of your hard drive, including any data you have stored or software you have installed, as well as to remove recording media (such as floppy discs, CDs) and peripherals from the Product before handing over the Product to the Sony–designated pick–up courier. If such programs, data, recording media and peripherals are within the Product at the time Sony receives the Product, Sony assumes that you have forgone all rights to such items. Sony will not be responsible for any damage to or loss of any peripherals, programs, data or other information stored on any media or any part of any Product serviced hereunder.
    • IF DURING THE REPAIR OF THE PRODUCT THE CONTENTS OF THE HARD DRIVE ARE ALTERED, DELETED OR IN ANY WAY MODIFIED, SONY IS NOT RESPONSIBLE WHATSOEVER. THE PRODUCT WILL BE RETURNED TO THE CUSTOMER CONFIGURED AS ORIGINALLY PURCHASED (SUBJECT TO AVAILABILITY OF SOFTWARE.
    • Be sure to remove all third party hardware, software, features, parts, options, alterations and attachments not warranted by Sony prior to sending the Product to Sony for repair. Sony is not liable for any loss or damage to these items.
    • Depending on the estimated length of the repair, parts availability, or the nature of the problem, Sony may repair the Product under terms and conditions that are different from those stated in this Terms and Conditions.
    • Depending on parts availability, Sony reserves the right to use the best available alternative part under local circumstances of the country in which the repair is conducted.
    • Sony does not offer on–site repair service under the Service.
    • Sony does not offer data back–up service at any time.
    • If telecommunication charges occur in contacting Sony (including international call charges and any other communication charges) to request repair, as well as for any other contact, you must cover the cost.
  22. Personal Data (Privacy)

  23. Sony has to collect your personal information (such as your name, address, phone number and passport number) (“your said Information”) as well as the serial number and date of purchase of the Product for providing the Services. Your said Information will be kept confidential at contact centers and repair centers of Sony subsidiaries in the designated countries for a reasonable period. For the purpose of confirming your entitlement and to render you the Service in the designated countries, Sony may share your said Information among the other authorized departments of our company and any associated companies in the Sony Group. You can always provide us with your latest personal information and/or require us to correct any data which is inaccurate or outdated. Nothing herein shall limit the rights of Customers under the Personal Data (Privacy) Ordinance. All instructions and queries from you will be followed up and answered at the earliest.
  24. Transference of The Service

  25. The Service is non–transferable.

  27. Sony reserves the right to change the nature and content of the Service at any time.
