"VAIO BBX" Contest

Terms and Conditions

Sony "VAIO BBX" Contest hereafter called “Contest” will be governed by the following Terms & Conditions:

1. Participation in the contest is voluntary.

2. Participants are advised to read the “Terms and Conditions”. Participation in the contest shall imply that the participant has duly read and agrees to adhere to and bound by the “Terms and Conditions” stated herein.

3. The contest shall commence from July 3, 2013 noon and shall terminate on July 31, 2013 noon.

4. The contest is open to citizens of India, residents in India only. Employees of Sony India Pvt. Ltd. (“Sony India”), Sony Entertainment television (SET), Sony Videos (SPE) and its affiliates, subsidiaries, representatives and immediate family members of such Sony group companies employees are not eligible to participate in the contest. Citizens of foreign countries residing in India/ or non-residents Indians are also not eligible to participate in the contest.

“How to Participate”, “Winners” & “Prizes”

5. Contest will be hosted on a special microsite hosted at http://www.sony.co.in/microsite/vaiosonic

6. A participant has to be a Facebook and YouTube user.

7. Participants can login to the contest using their Facebook profiles (https://www.facebook.com, username and password). After login, participants will be directed to the entry submission page where user can upload their entry video.

8. On the contest dashboard, participants can upload their beat boxing video. Only one video per participants is allowed. The video must be a YouTube video. The entry once done cannot be changed later.

9. All participants’ videos will be visible at the “Gallery” section. Sony India will scrutinise all videos for conditions mentioned under the ambit of “REJECTION/DISQUALIFICATION”. Any video found flouting the “REJECTION/DISQUALIFICATION” terms will be deleted immediately without any prior notice to the participant. Sony India cannot be held liable for such action.

10. Any participants can vote only once for his/ her or any other participant’s video. A user can also revoke his/ her vote to an entry.

11. All submissions will be visible on “Gallery” section.

12. All videos will be scored on the basis of votes to that particular entry. Every vote will add one point to the total score of the entry and subtract one point if vote is revoked. Based on this formula, top profiles will be visible at the “Leaderboard” section. Sony India will consider the top 30 valid profiles from these participants to shortlist five profiles.

13. Sony India reserves the sole rights to shortlist top 30 profiles to further shortlist five profiles

14. The shortlisted five profiles will compete for top position in another contest that will be held in Google Hangout.

15. Sony India shall not be liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury or death, or loss of, or damage to property, which might be suffered or sustained in connection with the Offer or the prize, except to the extent to any liability not excluded by law.

16. As applicable, in no event shall YouTube, its parent corporation, affiliates, officers, directors, employees, or agents, be liable to you for damages resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage (iii) any unauthorized access to or use of our secure servers (iv) any interruption or cessation of transmission to or from YouTube, (v) any bugs, viruses, trojan horses, or similar issues if transmitted to or through YouTube by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred. This limitation of liability applies to the fullest extent permitted by law in the applicable jurisdiction.

17. As applicable, you agree to defend and indemnify YouTube, its parent corporation, affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to YouTube for your contest under these policies; (ii) your violation of any term of the contest policies; (iii) any violation within your contest of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim from any third party relating to or arising from your contest; or (v) any claim that your contest violates any law, rule or regulation. This defense and indemnification obligation will survive these policies and your use of YouTube.

“REJECTION/DISQUALIFICATION”

18. Sony India reserves the right to disqualify any entry if:

Participant’s video is not a Beat Box video.
Participant’s video does not involve participant’s performance in the video.
Participant does not own the submitted video
Any Participant using manipulative means to garner more votes or jeopardise any otheror jeopardise any other Participant’s entry by any means

19. Any participant’s video or text which is insulting, rude, appalling, insensitive, offensive in nature/ against moral sensibilities shall be not be considered for participation and duly rejected right away. We strongly discourage rude or insulting posts or entries, personal attacks or purposeless inflammatory posts, use of abusive language and profane words in your post or for any other participant/s. We will block all such Facebook profiles from the Contest right away.

20. Sony India reserves the right to disqualify any participant / even winner if it has reasonable reasons to believe that the participant/winner has breached any of the “Terms and Conditions” of the contest.

21. Sony India will do rigorous background check on the activities related to participation in this contest to ensure that only genuine participants win the contest. Sony India will also send direct messages to any participant to check upon the person’s participation at the Contest

22. Any participant found to be copying other participants/non-participants video/text or using any unauthorized or copyrighted video/text shall be immediately banned from the Contest. Sony India shall not be liable for any copyright claims arising so forth.

23. Sony India shall not be responsible in any manner to anybody including any of the participants for the misuse of any video/text submissions at this Contest.

24. Any Participant using manipulative means to garner more votes or jeopardise any other Participant’s entry by any means shall be banned from the Contest.

25. Sony India will do rigorous background check on the activities related to participation and voting in this contest to ensure that only genuine participants win the contest. Sony India will also send direct messages to any participant or voter for any participant to check upon the person’s participation at the Contest

26. Sony India reserves the right to shortlist 5 participants in the event of disqualification/rejection of any of the participant.

“WINNERS”

27. Sony India and a jury appointed by Sony India reserves the sole rights to shortlist 5 participants from the top 30 valid profiles appearing at the “Leaderboard” section only. Their decision on the shortlisted participants is final and binding for all participants.

28. Sony India will do a rigorous check to verify the authenticity of winners/participants. This would include a check on the genuinity of the video submitted by the winner and even other participants. All 5 shortlisted participants will be required to provide proof of the ownership of the submitted videos. Sony India can ask for any proof from the winner or any participant to validate that he has clicked the submitted video, failing which the winner /participant may be cancelled/ removed from Contest right away. This is just to ensure that only genuine people participate and have a chance to win the Contest and spurious Facebook accounts are kept away from the contest.

29. The shortlisted participants shall be invariably required to produce valid identity proofs & proof to validate that he/ she is the owner of the submitted video. The shortlisted participants shall be required to provide self-attested proof of identity, proof of residence, email copy and all other necessary documents for verification. In case of the validation failure, the selection in top 5 will be cancelled.

30. All 5 shortlisted participants must submit all documents for reviews in the manner communicated by Sony India. In case the shortlisted participants fail to contact the specified person on or before the designated date i.e. August 1, 2013 the shortlisted participants shall be deemed to have surrendered the spot in top 5.

31. Sony India may, without advance notice cancel, suspend or postpone the contest at any time.

32. The ‘Terms and Conditions’ contained herein and as amended/ modified from time to time as mentioned at the Sony India’s website http://www.sony.co.in shall apply to this Contest.

33. In case of change in date of event or cancellation thereof for any reason beyond control of Sony India, Sony India shall not be responsible in any manner whatsoever.

34. Disputes relating to this Contest shall be subject to the exclusive jurisdiction of courts in Delhi only.

35. Contest is not applicable in the State of Tamil Nadu.

36. Participants who have not attained the age of majority i.e. 18 shall be required to get a written consent from the parent/ guardian in order to claim prize.

37. Winners must claim the prize & submit all documents for reviews in the manner communicated by Sony. In case the winner fails to contact the specified person on or before the designated date i.e 15th. Aug’13 the Winner shall be deemed to have surrendered the prize/s.

38. Top 5 shortlisted participants will get a chance to perform the song “Moves like Jagger” live in Google Hangout in front of the Shlomo on 8th August, 2013

39. Winner will get a VAIO F15 and certificate of appreciation from Shlomo

40. 1st and 2nd runner-up will get a certificate of appreciation from Shlomo

CHANGES TO THE TERMS AND CONDITIONS

41. We may change these conditions from time to time without prior notice. It is the User’s responsibility to check regularly, in order to ascertain if any changes have been made to these Terms and Conditions.
